The second appeal has been dismissed owing to non-appearance of the learned counsel for the appellant, on 24.03.2017.
2. The present application has been filed to condone the delay of 548 days in filing petition to restore the second appeal. In the affidavit filed in support of the said affidavit, it had been stated that the wrong name of the counsel was printed in the cause list, consequently the counsel on record was not able to appear before this Court.
3. Heard the learned counsel for the respondent. In view of the fact that appeal has been admitted and substantial questions of law has been framed, duty is cast on the Court to hear both the learned counsel for the appellant and respondent on merits.
4. The delay stands condoned and the Registry may put up the application to restore the Second Appeal in C.M.P.SR.No.117883 & 117884 of 2018 and number the same if they are otherwise in order. 08.06.2022 mrm https://www.mhc.tn.gov.in/judis
