..Respondents Prayer: Criminal Original Petition filed under Section 482 Cr.P.C. to direct the respondents to give police protection to the petitioner for fencing his lands in Survey No.451/1, to an extend of 0.50 cents situated at Puthur Agragaram Village, Veerapandi Sub-Division, Salem Taluk and District as per the complaint of the Petitioner dated 26-07-2018, 20-09-2018 and take action in accordance with law and thus render justice. ORDER

This Criminal Original Petition has been filed seeking for Police protection to the petitioner for fencing his land in Survey No.451/1.

The learned counsel for the petitioner would submit that the petitioner is the owner of the above said property and the patta has also been granted in his favour by the Zonal Deputy Tahsildar by his proceedings dated 18.11.2016. Since the property of the petitioner abets the Government Porambokku Land, the petitioner wants to fence their property, since the land grabbers were attempting to encroach upon the land of the https://hcservices.ecourts.gov.in/hcservices/

petitioner. The petitioner has also given a complaint dated 20.09.2018 to the respondents police seeking for necessary police protection to fence the land and the same is pending before the second respondent. Therefore, the present petition has been filed seeking for police protection to fence the land belonging to the petitioner.

3. The learned Additional Public Prosecutor would submit that the complaint has been received by the second respondent and the second respondent will call for an enquiry and taken appropriate decision in accordance with law.

4. In the facts and circumstances of the case, the second respondent is directed to consider the complaint given by the petitioner seeking for police protection in order to fence the property. If the second respondent finds that there are valid documents on the side of the petitioner and the petitioner only wants to safeguard his property from which is abetting the Government Porambokku Land, the respondents police can consider granting protection to the petitioner in order to fence their property.

With the above direction, this Criminal Original Petition is disposed of.
