2. A perusal of sale agreement dated 09.04.2013 does not show any covenant regarding handing over the possession of the property to the 1st respondent/plaintiff by the appellant/defendant. However, contrary to that, there is a finding by the Trial Court that the 1st respondent/plaintiff is in possession of the property. Moreover, the appellant challenged the very sale agreement itself stating that it is only a loan transaction and not sale agreement.
