C.M.P.No.19526 of 2018 in C.R.P.(NPD)No.1132 of 2014 R.PONGIAPPAN, J., Today, when the petition is taken up for hearing, the learned counsel appearing for the petitioner is present and made a submission that in Rent Control Original Proceedings, the second respondent, namely, Kala herein remained exparte and thereby, he pleased to order to dispense with the service of notice on the second respondent, for which, he has filed a Petition in C.M.P.No.19526 of 2018.
2. Now, on going through the affidavit filed in support of this petition by the petitioner, he has clearly stated that the second respondent remained ex parte in the lower court. Hence, this Civil Miscellaneous Petition to dispense with the service of notice on the second respondent, is allowed.
