SATHI KUMAR SUKUMARA KURUP, J., Learned Counsel for the Revision Petitioner in C.R.P.No.1008 of 2021 submitted that the Plaintiffs in O.S.No.46 of 2011 on the file of the learned Subordinate Judge, Sankari. The suit was filed for the relief of partition and separate possession. At the time of institution of the suit, some properties were left out, and the preliminary decree was passed in favour of the Plaintiffs. Subsequent to the passing of the preliminary decree, I.A.No.533 of 2012 was filed to amend the suit by adding some more property in the schedule of the properties and Respondents/Defendants objected to the same.
2.After due enquiry, the prayer of the Plaintiffs in O.S.No.46 of 2011 to include three properties was rejected. Only one of the properties was allowed to be included, and the two other properties were rejected. Therefore, the Plaintiffs in O.S.No.46 of 2011 had filed two Civil Revision Petitions in C.R.P.Nos.1008 of 2021 & 3095 of 2022. O.S.No.46 of 2011 filed C.R.P.No.3095 of 2022. 3.The learned Counsel appearing for the Revision Petitioner in C.R.P.No.1008 of 2021 and the learned Counsel appearing for the Revision Petitioners in C.R.P.No.3095 of 2022 are present before this Court. 4.At request of the learned Counsels on either side, post the matter on 28.06.2023.
