PRAYER in O.P.No.943 of 2018 and O.P.No.945 of 2015: Petition filed under Section 11 (6) of the Arbitration & Conciliation Act, 1996, praying to appoint a Sole Arbitrator to decide the dispute between the Petitioners and the Respondent arisen out of the claim made by the petitioner to the respondent under the Standard fire and Special Perils Policy Nos.2114/53167686/02/000 and 2114/52813329/02/000 respectively, with the respondent Insurance company. For Petitioners : Mr.K.Moorthy For Respondent : Ms.R.Sreevidhya * * * C O M M O N O R D E R These Original Petitions has been filed by the petitioners seeking to appoint a Sole Arbitrator to decide the dispute between the Petitioner and the Respondent arisen out of the claim made by the petitioner to the respondent under the Standard fire and Special Perils Policy Nos.2114/53167686/02/000 and 2114/52813329/02/000 respectively, with the respondent Insurance company.
2. When the matter is called for hearing today, both the learned counsel appearing for petitioner and respondent by consensus proposed the name of agreed Mr.R.Yashod Vardhan be appointed as Sole Arbitrator in the above petition to adjudicate upon the disputes inter se the parties.
3. I thus appoint R.Yashod Vardhan, Senior Advocate, No.155, Linghi Chetty Street, III Floor, Chennai - 600001, Mobile:9841075397, as the Sole Arbitrator to enter upon the reference and after issuing notice to the parties and upon hearing them, pass an award as expeditiously as possible within a period of six months from the date of receipt of the order. The learned Arbitrator is at liberty to fix his remuneration as well as schedule of expenses which shall be borne by both parties equally. The proceedings may be conducted under the aegis of the Madras High Court Arbitration Centre and in accordance with the Madras High Court Arbitration Rules.
4. These Original Petitions are ordered accordingly leaving the parties to bear their own cost.
