ORDER : The Court Made the following order :- The petitioner/A7, who apprehends arrest at the hands of the respondent-police for the offence punishable under Sections 4(1)(A), 4(1)(aaa) of TNP Act, r/w 6, 7 of TN Rectified Spirit Rules 2000, in Crime No.571 of 2018, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with some other accused person were found to be in possession of 630 litres of rectified spirit suspected to be poisonous and the same was recovered. In this regard, the defacto-complainant has given complaint before the respondent-police and the same was registered.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and she did not commit any offence as alleged by the prosecution. 4. The learned Government Advocate (Crl. Side) would submit that 19 previous cases are pending against the petitioner and there is no change of circumstances for entertaining this anticipatory bail application. The petitioner/Accused No.7 has filed a petition in Crl.O.P.No.23939 of 2018 seeking anticipatory bail, who is having 19 previous cases of similar in nature and the same was dismissed on 11.10.2018.
5. It is seen that earlier this Court dismissed the anticipatory bail application of the petitioner by an order dated 11.10.2018 considering the gravity of offence committed by the petitioner and at present also there is no change of circumstances to grant anticipatory bail to the petitioner. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
