This Transfer Civil Miscellaneous Petition has been filed under Section 24 of the Code of Civil Procedure to withdraw the case i.e. H.M.O.P.No.878 of 2018 pending on the file of the Family Court, Madurai and transfer the same to the file of the Additional Family Court No.II, Chennai, to be tried along with the case H.M.O.P.No.2876 of 2018 pending on its file.
2. Today when the petition is taken up for hearing, the learned counsel appearing for the petitioner as well as the learned counsel appearing for the respondent are present. Both of them represented that, on 07.01.2019, while at the time of disposing the Tr.C.M.P.(MD)No.420 of 2018 the Madurai Bench of this Court passed an order for withdrawing the case H.M.O.P.No.2876 of 2018 from the file of the Additional Family Court No.II, Chennai and to transfer the same to the file of the https://hcservices.ecourts.gov.in/hcservices/
Family Court, Madurai, for disposing along with H.M.O.P.No.878 of 2018. Accordingly, the prayer sought for by the petitioner has become infructuous.
3. In this regard, the learned counsel appearing for the petitioner has filed a memo stating that the petitioner is going to file a revision petition against the order passed by the Madurai Bench of this Court in Tr.C.M.P.(MD)No.420 of 2018. Even though the revision petition has been filed against the order passed by this Court, already the issue raised in this petition was settled and hence, nothing survives in keeping this bundle no longer. Accordingly, the Transfer Civil Miscellaneous Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
