PRAYER: Criminal Original petition is filed under Section 482 of Criminal Procedure Code, to direct the 2nd respondent, not to harass the petitioner and his family members. For Petitioner : Mr.A.Nagarathinam For Respondents : Mr.M.Mohamed Riyaz Additional Public Prosecutor
ORDER
This Criminal Original Petition has been filed seeking for a direction to the second respondent police not to harass the petitioner and his family members.
2.Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the respondents. 3.The learned counsel for the petitioner would submit that there is a property dispute pending between the petitioner and his brother. On the basis of the complaint given by the petitioner's brother, the respondent Policies is calling the petitioner regularly for enquiry and harassing the petitioner. 4.The nature of the dispute that has been projected in this case is purely civil. If the respondents Police finds that the dispute is among brothers with regard to the property, the https://hcservices.ecourts.gov.in/hcservices/
parties may be relegated to an appropriate civil forum and the respondent Police shall not harass the petitioner in the name of enquiry.
5.This Criminal Original Petition is disposed of with above direction.
