Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorari calling for the entire records relating to the impugned order issued by the 1st respondent in his proceedings revision No.18/2017, Na.Ka.No.9453/2017/A2 dated 09.03.2018 quash the same.

ORDER

The second respondent was placed under suspension from service through an order dated 22.04.2017. When the second respondent had filed a revision under Section 153 of Tamilnadu Co-Operative Societies Act, before the first respondent herein, the same was allowed on 09.03.2018, which order is under challenge in the present writ petition.

The learned counsel appearing for the petitioner https://hcservices.ecourts.gov.in/hcservices/

submitted that, prior to the order dated 09.03.2018 passed by the first respondent under Section 153 of the Tamilnadu CoOperative Societies Act, 1961, the second respondent was dismissed from service on 03.03.2018 itself. As such, the order of the first respondent has become redundant. If at all the second respondent is aggrieved against the order of dismissal passed by the petitioner, it is open to him to challenge the same in accordance with law.

Since, no effective orders can be passed, the present writ petition stands closed. Consequently, connected miscellaneous petitions are closed. No costs. However, liberty is granted to the second respondent to challenge the order of termination, which has already been passed, without any reference to the observations made in this order.
