O.P.No.1132 0f 2018 R.SUBRAMANIAN, J., The Petitioners seek issuance of Succession Certificate in respect of the securities that stand in the name of T.K.Krishnamoorthy, who died intestate on 08.09.2013. The petitioners are the daughter and sons of the deceased T.K.Krishnamoorthy.

2.The second petitioner has been examined as P.W.1. He has produced the Death Certificate of T.K.Krishnamoorthy as Ex.P.3. The Death Certificate of K.Subhadra, wife of T.K.Krishnamoorthy has been produced as Ex.P.1.The Legal Heirship Certificate of T.K.Krishnamoorthy has been produced as Ex.P.4. A perusal of the same shows that the petitioners are the legal heirs of the deceased T.K.Krishnamoorthy. The petitioners 1 and 3 have filed Consent Affidavits for grant of Succession Certificate in favour of the second petitioner. The said Consent Affidavits have been marked as Ex.P.6 and Ex.P.7. Paper publication has been effected and no objection has been received.

3.In view of the above evidence, I find that the petitioners are entitled to get Succession Certificate in respect of the securities mentioned in the Schedule to the petition. The Original Petition is allowed granting

Succession Certificate in respect of the securities mentioned in the Schedule to the petition in favour of the second petitioner. 26.04.2019 tsg
