This petition is filed to condone the delay of 43 days in filing the appeal.

2.Heard the learned counsel for the petitioner and Mr.K.Varadha Kamaraj, learned counsel, who is already on record, on behalf of the respondents 1 to 4.

3.The fifth respondent was set exparte before the Trial Court and as such, notice to the said respondent is dispensed with.

4.In view of the reasons found mentioned in the affidavit filed in support of the Miscellaneous Petition, the delay is condoned.

The Miscellaneous Petition is allowed.
