Respondents Prayer:- This Writ Petition is filed, under the Article 226 of Constitution of India, to issue a Writ of Mandamus to direct the Respondents 1 and 2 to consider the representation of the Petitioner, dated 30.10.2018 and release the Ashok Leyland Lorry, bearing Reg.No.TN 23 BD 2279 to the Petitioner. ORDER

The prayer in this Writ Petition is to direct the Respondents 1 and 2 to consider the representation of the Petitioner, dated 30.10.2018 and release the Ashok Leyland Lorry, bearing Reg.No.TN 23 BD 2279 to the Petitioner.

2. This Court heard the learned counsel on either side and also perused the materials placed on record.

3. According to the learned Additional Government Pleader for the Respondents, pursuant to the order passed by the Division Bench of this Court,dated 29.10.2018 in WP(MD)Nos.19936 of 2017 and 7595 of 2018, general directions have been issued to the Respondents to proceed with the seized vehicle in question by the Department. Further, in compliance of the said order of the Division Bench of this Court, the 3rd Respondent had https://hcservices.ecourts.gov.in/hcservices/

preferred a complaint before the Station House Officer, Tindivanam, Villupuram District and a case was registered in FIR.No.904 dated 28.11.2018. A copy of the said FIR has also been produced before this Court.

4. In the light of the aforesaid order of the Division Bench of this Court, it is open to the Petitioner to seek appropriate relief before appropriate forum. Accordingly, this Writ Petition is dismissed. No costs.
