PARTHIBAN CRIMINAL MISCELLANEOUS PETITION No.15811 of 2018 IN CRL RC.1316/2017 P.NALLASAMY [ PETITIONER ] Vs M/S.ARTHI FOOD PRODUCTS [ RESPONDENT ] PROP.S.KRISHNAMOORTHY Petition praying that in the circumstances stated therein the High Court will be pleased to permit the petitioner to withdraw the amount of Rs.1,00,000/- lying in the STC No.423/2014 on the file of the Judicial Magistrate (Fast Track) Court No.II, Erode which is the subject matter of the above revision in Crl.R.C.No.1316 of 2017 on the file of this Hon`ble High court.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of MR.I.C.VASUDEVAN ADVOCARE FOR M/S.SRI.TITUS ENOC, Advocate for the petitioner the court made the following order:- The present petition has been filed seeking to withdraw the amount of Rs.1,00,000/-, lying to the credit of S.T.C.No.423 of 2014, on the file of the Judicial Magistrate (Fast Track) Court No.II, Erode.

2. According to the learned counsels appearing for the parties, the matter has been compromised before the Lok Adalat and the respondent herein (revision petitioner) had already deposited a sum of Rs.1,00,000/- (Rupees One Lakh only) to the credit of S.T.C.No.423 of 2014, on the file of the Judicial Magistrate (Fast Tract), No.II, Erode.

3. Since a compromise has been reached between the parties, the petitioner is before this Court seeking to withdraw the amount deposited by the respondent herein. The learned counsel for the respondent/revision petitioner stated that he has no objection for allowing the petition.

4.In the light of the above, this petition is allowed and the petitioner is permitted to withdraw the amount lying to the credit of S.T.C.No.423 of 2014, on the file of the Judicial Magistrate (Fast Tract Court No.II), Erode.
