O R D E R

This petition has been filed to quash the proceedings in C.C.No.6080 of 2017 filed against the petitioner under section 138 of the Negotiable Instruments Act on the file of the XIX Metropolitan Magistrate, Egmore, Chennai.

2. When the matter is taken up today, there is no representation for the petitioner.

3. This Court while granting stay, directed the petitioner to deposit a sum of Rs.40,00,000/- to the credit of the case in C.C.No.6080 of 2017 on the file of the XIX Metropolitan Magistrate, Egmore, Chennai. Whether the said Order has been complied or not, has not been known. At any event, this Court cannot go into the evidence by conducting roving enquiry and it is for the petitioner to establish his case before the trial Court.

4. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
