ORDER

This Writ Petition has been filed to call for the records on the file of the second respondent in his proceedings in Rc.No.34255/2006/A3 dated 21.06.2018 and quash the same in view of the Honourable acquittal by this Court in Crl.A.No.219 of 2012 dated 22.08.2017.

2. Heard Mr.R.Jayaprakash, learned counsel for the petitioner, Mr.A.M.Ayyadurai, learned Government Advocate for the respondents and perused the materials available on record.

3. It is learnt that the respondents sent a pension proposal to the petitioner stating that there is no disciplinary proceedings pending. That would only show that though the petitioner was kept under suspension, no disciplinary action had been contemplated to be initiated against him before his attaining the age of superannuation. As the petitioner was allowed to retire on 31.08.2019, the impugned order is liable to be quashed. Since the period of suspension is also regularised, nothing survives for further consideration in this Writ Petition. Page No.2 of 4

4. In the result, this Writ Petition is disposed and the impugned order passed in Rc.No.34255/2006/A3 dated 21.06.2018 is quashed. No costs. Consequently, connected miscellaneous petition is closed. Index : Yes /No 12.03.2025 Speaking / Non-speaking gsk Page No.3 of 4
