PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 2nd respondent herein not to harass the petitioner under the guise of enquiry on the basis of the complaint given by Mr.Nageswarao Rao in any manner except due process of law.

O R D E R

The learned counsel for the petitioner would submit that the petitioner's brother Nageswarao Rao, had borrowed some money and later he died. For the purpose of recovering the said money, the creditors have given a complaint before the respondent police and the respondent police is repeatedly asking the petitioner to attend for enquiry. According to the learned counsel for the petitioner, the petitioner has attended the enquiry atleast seven times before the respondent police.

2. It is seen that the entire dispute revolves around payment of money. The respondent police is directed to relegate the parties to the proper civil forum and the respondent police shall not interfere with the dispute, if it is found that the dispute is purely civil in nature.

3. With the above said direction, this Criminal Original Petition is disposed of.
