Criminal Revision Petition filed under Article 397 r/w 401 of Criminal Procedure Code to set aside the order dated 16.04.2018 made in Tr.M.P.No.932 of 2018 on the file of the Chief Metropolitan Magistrate, Egmore, Chennai and consequently direct the learned Chief Metropolitan Magistrate, Egmore, Chennai to effect transfer of the C.C.No.6836 of 2005 on the file of the V Metropolitan Magistrate, Egmore, Chennai to any other Metropolitan Magistrate, Egmore, Chennai. It is seen that the case was registered by the respondent police against the revision petitioner in Crime No.2567 of 2004 dated 27.11.2004. After investigation, the respondent police filed a charge sheet against the revision petitioner. Thereafter, the learned V Metropolitan Magistrate, Egmore, taken up the case on file in C.C.No.6836 of 2005, during trial the accused has filed a petition before the Chief Metropolitan Magistrate in Tr.C.M.P.932 of 2018 in C.C.No.6836 of 2005, for transferring the case from the file of learned V Metropolitan Magistrate, Egmore to some other Court. After proceedings, the learned Chief Metropolitan Magistrate, Chennai, dismissed the transfer petition. As against the said order of dismissal the revision petitioner filed the present revision case before this Court.

Today when the matter is came up for hearing, there is no representation on behalf of the petitioner either in person or through his counsel, despite giving several opportunity, there is no representation.

On a perusal of entire materials the learned Chief Metropolitan Magistrate elaborately discussed the matter and given the reason for dismissing the transfer of the case, from the file of V Metropolitan Magistrate Court, to some other Court. Though, he has filed the revision petition against the order of the Chief Metropolitan Magistrate before this Court the petition is also shows that the petitioner is adopting tactics to protract the trial Court in C.C.No.6836 of 2005, therefore this Court does not find any merit in this revision. Accordingly, this Criminal Revision is dismissed. The learned V Metropolitan Magistrate, Egmore is directed to dispose of the case within a period of three months from the date of receipt of a copy of this order. Consequently, connected Criminal Miscellaneous Petition is closed.
