JUDGMENT

(Delivered by the Hon'ble Chief Justice) We have heard Mr.R.Bharath Kumar, learned counsel for the petitioner and Mr.A.Edwin Prabakar, learned State Government Pleader, assisted by Mr.T.K.Saravanan, learned Government Advocate for the respondents.

2. The issue is with regard to the grant of patta.

3. The learned Single Judge has observed that if the appellant/writ petitioner claims that he is the owner of the property, then, he is at liberty to approach the competent civil Court of law to establish his civil rights.

4. The learned Single Judge has adopted the proper approach. The disputed questions cannot be effectively considered in the writ petition.

5. In the light of the above, it is for the appellant to take recourse to the proceedings before the civil Court as may be permissible under law.

6. With the aforesaid observation, the appeal is disposed of. There shall be no order as to costs.
