Petition praying that in the circumstances stated therein the High Court will be pleased to (i) Suspend the Sentence imposed on the petitioner by a judgment dated 26.09.2018 passed by the learned XVII Addl.City civil/Sessions Judge, Chennai dismissing the Criminal appeal and by confirming the judgement dated 09.03.2018. [CRL.M.P.No.15322 of 2018]. (ii) Exempt from surrendering the petitioner in pursuant to the judgment dated 26.09.2018 passed by the learned XVII Additional City Civil/Sessions Judge, Chennai dismissing the Criminal Appeal and by confirming the Judgment dated 09.03.2018 [CRL.M.P.No.15326 of 2018]. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of MR.R.SANKARASUBBU for M/S.V.SATHISH, Advocate for the petitioner, in both petitions and of MR.G.
HARIHARA ARUN SOMA SANKAR Government Advocate on behalf of the Respondent, in both petitions the court made the following order:- Crl.M.P.No.15322 of 2018, has been filed seeking to suspend the sentence imposed on the petitioner by the learned XVII Additional Judge, City Civil Court, Chennai, dated 26.09.2018 in C.A.No.118 of 2018 and enlarge the petitioner on bail till the disposal of Criminal Revision, the petitioner is before this Court with this petition.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondent.
3. Having regard to the facts and circumstances of the case, the miscellaneous petition in Crl.M.P.No.15322 of 2018, is allowed and the sentence passed by the learned XVII Additional Judge, City Civil Court, Chennai, dated 26.09.2018 in C.A.No.118 of 2018, is suspended on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Chief Metropolitan Magistrate, Egmore, Chennai. Further, the petitioner shall appear before the trial Court on every first working day of every month at 10.30 a.m until further orders.
4. In view of the suspension of sentence, the petitioner is exempted from surrendering before the learned Chief Metropolitan Magistrate, Egmore, Chennai and Crl.M.P.No.15326 of 2018 is ordered accordingly.
