ORDER

This Writ Petition is filed praying to issue a writ of Mandamus to direct the respondents to forthwith return the Medium Goods Carrier Vehicle-106 (Swaraj Maid-Tipper) bearing Registration No.TN 60 AX 0803 to the Petitioner.

2. On 17.12.2018, when the matter was listed for hearing, this Court directed the Tahsildar, Ambur, Vellore District, to be present and report the status of the case. Accordingly, Ms.R.Sujatha, Tahsildar, Ambur, Vellore District is present before this court today.

3. The learned Additional Government Pleader appearing for the respondents would submit that on the complaint preferred by the Village Administrative Officer, Ambur Taluk, a case has been registered in Crime No.425 of 2018 on 17.12.2018 under Section https://hcservices.ecourts.gov.in/hcservices/

379 IPC read with 21(1) of the Mines and Minerals (Development and Regulation) Act, 1957 on the file of Oomerabad Police Station, Vellore District. He has also produced a copy of the FIR before this court.

4. Recording the above submission, the Writ Petition is dismissed with liberty to the Petitioner to seek proper remedy before the appropriate forum. No costs.
