Mr.K.Rajendra Prasad Additional Government Pleader Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondent to consider the representation dated 01.08.2017 and reinstate the petitioner in service as Head Constable with all consequential benefits like continuity in service, arrears of pay, annual increments etc.,.

O R D E R

The petitioner was working as a Head Constable and he was compulsorily retired by way of punishment in view of the conviction in a criminal case for the offence under Section 138 of the Negotiable Instruments Act. He filed an appeal and the conviction and sentence was set aside. However, the petitioner was not reinstated in service and hence the present writ petition is filed by the petitioner to consider his representation dated 01.08.2017 and to reinstate the the petitioner in service as Head Constable with all consequential benefits like continuity in service, arrears of pay, annual increments etc.,

2. Mr.K.Rajendra Prasad, learned Additional Government Pleader takes notice on behalf of the respondents. Heard the learned counsel appearing on either side and perused the materials available on record.

3. In view of the limited relief sought for, this Court is of the view that it is not necessary to dwell into the merits of the issue, but it would be suffice to direct the respondents to https://hcservices.ecourts.gov.in/hcservices/

consider the representation of the petitioner dated 01.08.2017 and pass orders on the same within a particular time frame.

In the above circumstances, this writ petition is disposed of directing the 1st respondent to consider the representation of the petitioner dated 01.08.2017 and pass orders thereon, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
