This petition is filed to condone the delay of 261 days in preferring the above Civil Miscellaneous Appeal.

2.Mr.Richard Suresh Kumar, learned counsel takes notice for the respondents 1 to 4 and submitted that the respondents have no objection in ordering this petition.

3.The learned counsel for the petitioner submitted that the fifth respondent remained exparte before the Tribunal and hence, no notice is necessary for the fifth respondent.

4.Heard the learned counsel appearing for the petitioner as well as the respondents 1 to 4.

5.Recording the no objection given by the learned counsel for the respondents 1 to 4 and being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 261 days is condoned and the petition is ordered. It is made clear that the petitioner/appellant is not entitled for any interest for the compensation amount enhanced, if any, in the appeal.
