ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 397 of IPC and no previous case is pending, seeks anticipatory bail. 2.The learned counsel appearing for the petitioners would submit that on 06.09.2018, due to that he was arrested by the Inspector of Police, Mudaliarpet Police Station in another case the petitioners were not able to appear before the learned Principal Assistant Sessions Judge, (Subordinate Judge), Tindivanam, Villuppuram District, in respect of the case in S.C.No.
279 of 2017 and hence, non bailable warrant has been issued against the petitioners. He would further submit that the said absence is neither willful nor wanton and he undertakes that the petitioners shall appear before the Court below regularly on all future hearing dates without fail. 3.Heard the learned Additional Public Prosecutor appearing for the respondent.
4.Considering the undertaking given by the learned counsel for the petitioners, the petitioners are directed to appear before the learned Principal Assistant Sessions Judge, (Subordinate Judge), https://hcservices.ecourts.gov.in/hcservices/
Tindivanam, Villuppuram District, within a period of 2 weeks from today and to file a petition to recall NBW already issued against the petitioners. On filing of such petition, the concerned learned Principal Assistant Sessions Judge, (Subordinate Judge), is directed to consider the same on merits in accordance with law and pass orders on the same day.
