PARTHIBAN CRIMINAL MISCELLANEOUS PETITION No.15266 and 15265 of 2018 IN CRL RC.1297/2018 S.DHARMALINGAM [ PETITIONER IN BOTH THE PETITIONS] Vs SHANMUGAM [ RESPONDENT ] IN BOTH THE PETITIONS] Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Revision Case No.1297/2018 on the file of the High Court, the High Court will be pleased to [i]suspend the sentence imposed and the payment of compensation ordered in C.C.No.463 of 2009 on the file of the Judicial Magistrate Court No.II, Salem on 29.01.2013 and confirmed in C.A.No.17 of 2013 on the file of the II Additional District and Sessions Judge,Salem on 27.09.
2018 and enlarge the petitioner on bail pending disposal of the above Criminal Revision petition.[CRL.MP.NO.15266/2018] [II]exempt the petitioner from surrendering in C.C.NO.463 OF 2009 on the file of the Judicial Magistrate Court No.II,Salem, [CRL.MP.NO.15265/2018] Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.Revision Case No.1297/2018 on the file of the High Court and upon hearing the arguments of M/S.P.MANI Advocate for the petitioner[IN BOTH THE PETITIONS] the court made the following order:- The sentence passed against the petitioner in C.C.No.463 of 2009 dated 29.01.2013, by the learned Judicial Magistrate Court No.II, Salem, be suspended on condition that the petitioner shall deposit 50% of the cheque amount viz., Rs.
1,50,000/- within a period of two weeks from the date of receipt of a copy of this order.
2. If the deposit is not made within the time stipulated by this Court, the order of suspension of sentence shall stand automatically vacated without any further reference to this Court. https://hcservices.ecourts.gov.in/hcservices/
3. In view of the suspension of sentence, the petitioner is exempted from surrendering before the learned Judicial Magistrate Court No.II, Salem and Crl.M.P.No.15265 of 2018 is ordered accordingly.
