PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to call for the records in the Crime No.33 of 2018 on the file of the respondent and quash the same as against the petitioner.

O R D E R

This petition has been filed seeking to quash the F.I.R.in 33 of 2018, pending on the file of the first respondent.

2. The learned counsel for the petitioner would submit that the petitioner has a Passport in his name, which is valid up to 17.02.2025. The petitioner had originally approached an agent in order to get a Passport and he had also received a Passport which expired on 06.12.2016 and thereafter it was renewed up to 13.02.2026. The learned counsel would submit that the petitioner never used any https://hcservices.ecourts.gov.in/hcservices/

duplicate Passport and there is already a Passport standing in his name.

3. A reading of the complaint reveals the fact that the petitioner has been using another Passport which stands in the name of Zakir Hussain. Therefore, on this ground the 2nd respondent has given a complaint to the 1st respondent Police and the 1st respondent police have registered an F.I.R for an offence under Section 12(1)(b) Passport Act,1967, and Sections 420,468 & 471 of IPC and the matter is pending investigation.

4. This Court, does not want to interfere with the F.I.R., at this stage, in view of the specific allegations that have been made in the F.I.R. However, there shall be a direction to the 1st respondent Police to complete the investigation and file a report within a period of three months from the date of receipt of a copy of this order.

5. The Criminal Original Petition is disposed of with the above directions. Consequently, connected miscellaneous petition is closed.
