Petitions praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL RC.1299/2018 on the file of the High Court, the High Court will be pleased to [i] suspend the sentence imposed by the learned V Learned Metropolitan Magistrate, Egmore, Chennai in C.C.No.8061 of 2014 and enlarge the petitioner on bail till the disposal of CRL RC.1299/2018 [IN CRL.MP.NO.15304 OF 2018] [ii] exempt the petitioner from surrendering in connection with C.C.No.8061 of 2014 on the file of Learned V Metropolitan Magistrate, Egmore, dated 19.09.2017, in CRL RC.1299/2018 [IN CRL.MP.NO.15309 OF 2018] Order : These petitions coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL RC.1299/2018 on the file of the High Court and upon hearing the arguments of M/S.R.

VIVEKANANTHAN, Advocate for the petitioner and of MR. G.HARI HARA ARUN SOMASANKAR, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- Crl.M.P.No.15304 of 2018, has been filed seeking to suspend the sentence imposed on the petitioner by the learned V Metropolitan Magistrate, Egmore, Chennai, dated 19.09.2017 in C.C.No.8061 of 2014 and enlarge the petitioner on bail till the disposal of criminal Revision, the petitioner is before this Court with this petition.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) appearing for the respondent.

3. Having regard to the facts and circumstances of the case, the miscellaneous petition in Crl.M.P.No.15304 of 2018, is allowed and the sentence passed by the V Metropolitan Magistrate, Egmore,

Chennai, dated 19.09.2017 in C.C.No.8061 of 2014, is suspended on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned V Metropolitan Magistrate Court, Allikulam, Chennai. Further, the petitioner shall appear before the trial Court on every first working day of every month at 10.30 a.m until further orders.

4. In view of the suspension of sentence, the petitioner is exempted from surrendering before the learned V Metropolitan Magistrate, Egmore and Crl.M.P.No.15309 of 2018 is ordered accordingly.
