Mr.A.N.Thambidurai Special Government Pleader Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the first and third respondent to consider the petitioner's representation dated 29.01.2016 and regularise the petitioner's service by taking count of 50% part time Village Assistant service rendered from 13.08.1963 to 31.10.1996 for the sanction of pension benefits in the light of G.O.Ms.No.33, Revenue (Ser-8 (1)) Department, dated 25.01.2010.

O R D E R

The petitioner is a retired Village Assistant. He was appointed as part time village assistant on and from 13.08.1963. After serving 33 years, he is seeking the benefits of G.O.No.33 Revenue (Ser-8(1)) Department dated 25.01.2010, by which the similarly placed person's pension was ordered to be regularised retrospectively with effect from 01.06.1995 in view of the order in SLP No.21683/09. The petitioner seeks to extend the same benefit to him by taking into account 50% of his services with effect from the date of his joining as Part Time Village Assistant ie., from 13.08.1963. So claiming, he has made a representation to the respondents dated 29.01.2016, which has not been considered till date, and that has made the petitioner to file the present writ petition.

2. Heard Mr.A.N.Thambidurai, learned Special Government Pleader for the respondents.

In view of the limited relief sought for, this Court is of the view that it is not necessary to dwell into the merits of the issue, but it would be suffice to direct the respondents to consider the representation of the petitioner dated 29.01.2016 and pass orders on the same within a particular time frame.

4. In the above circumstances, this writ petition is disposed of directing the respondents to consider the representation of the petitioner dated 29.01.2016 especially in the light of SLP No.21683 of 2009 and pass orders thereon, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
