Respondent PRAYER: This Writ Petition has been filed under Article 226 of the Constitution of India, praying to issue a writ of certiorari calling for the records of Deputy Commissioner of Labour, Salem (Authority under the Minimum Wages Act) in I.A.No.3 of 2018 in M.W.No.36 to 76 of 2017 ans quash the order dated 19.09.2018. ORDER

The application filed by the respondent herein before the Authority under the Minimum Wages Act, in I.A.No.3 of 2018, seeking for a direction to the petitioner for production of certain documents, came to be ordered. The petitioner herein is aggrieved against the nature of the documents which were sought to be produced.

2.According to the learned counsel for the petitioner, among the seven documents, the purchase bills and the sales invoices for a period of seven years commencing from the year 2010 are voluminous and may not be related to the main issue involved. However, the petitioner is willing to produce the other documents, apart from the purchase bills and sales invoices. The learned counsel for the respondent has also no objection to such submissions made by the learned counsel for the petitioner.

3.It is brought to the notice of this Court that the document referred to Serial No.1 has already been produced. In the light of the submissions made, the impugned order passed in I.A.No.3 of 2018 in M.W.No.36 to 76 of 2017, dated 19.09.2018 on the file of the Deputy Commissioner of Labour, Salem, (Authority under the Minimum Wages Act) is set aside, insofar as it relates to the direction to the petitioner-Management to produce documents for Serial No.4 pertaining to purchase bills for the period of seven years commencing from the year 2010 and Serial No.5 pertaining to the sales invoices for the period of seven years commencing from the year 2010 are concerned. The Interim order insofar as relates to the production of the documents for Serial Nos.2, 3, 6 & 7 are concerned, is confirmed and the petitioner-Management shall produce the certified true copies of these documents.
