ORDER : The Court Made the following order :- The petitioners, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 307 of IPC in Crime No.65 of 2012, seeks anticipatory bail. 2.The learned counsel appearing for the petitioners would submit that on 20.09.2017, due to illness, the petitioners were not able to appear before the learned IV Additional Sessions Judge, Chennai, in respect of the case in S.C.No.17 of 2014 and hence, non bailable warrant has been issued against the petitioners. He would further submit that the said absence is neither willful nor wanton and he undertakes that the petitioners shall appear before the Court below regularly on all future hearing dates without fail. 3.Heard the learned Additional Public Prosecutor appearing for the respondent.
4.Considering the undertaking given by the learned counsel for the petitioners, the petitioners are directed to appear before the learned IV Additional Sessions Judge, Chennai, within a period of 2 weeks from today and to file a petition to recall NBW already issued against the petitioners. learned IV Additional Sessions Judge, is directed to consider the same on merits in accordance with law and pass orders on the same day.
