Mr.P.Kannan Kumar Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondent to consider and dispose appeal submitted by the petitioner dated 05.03.2018 within time frame.
O R D E R
The petitioner, working as a Conductor, had retired from service after completion of 31 years of service. He was issued with a charge memo and not satisfied with the explanation of the petitioner, the management conducted a domestic enquiry. On the basis of the enquiry report, the petitioner was found guilty and was given the punishment of reduction in pay scale. The petitioner preferred an appeal in this regard on 05.03.2018, which has not been considered by the respondent till date, which has made the petitioner to file this writ petition. Learned counsel for the petitioner submits that in view of the family circumstances of the petitioner, the appeal may be directed to be disposed of at an early date.
3. Mr.Kannan Kumar, learned Standing Counsel takes notice on behalf of the respondent and submits that atleast 3 months time would be required to consider and dispose of the appeal.

In view of the limited relief sought for, this Court is of the view that it is not necessary to dwell into the merits of the issue, but it would be suffice to direct the respondents to consider the appeal preferred by the petitioner dated 05.03.2018 and pass orders on the same within a particular time frame.

In the above circumstances, this writ petition is disposed of directing the respondent to consider the appeal preferred by the petitioner dated 05.03.2018 and pass orders thereon, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
