PRAYER: Criminal Original petition is filed under Section 482 of Criminal Procedure Code, to issue directions, directing the respondent police to give adequate police protection to the Alamaratu Iyyan Temple situated at Vaipadi Village, Ketharankadu, Chennimalai during the festival viz., Karthigai Deepam and Pournami Poojas to be held on 22.11.2018 and 23.11.2018.

ORDER

This Criminal Original Petition has been filed seeking for police protection to conduct the Temple Festival.

2. The learned Government Advocate, on instructions, would submit that there is a rival party who is also claiming a right to conduct the temple festival. The learned counsel would further submit that the respondent Police have already placed the matter before the Tahsildar, Perundurai, to conduct the peace committee meeting in order to see if the festival can be conducted peacefully, without giving rise to any law and order problem. According to the learned Government Advocate, the enquiry is pending before the concerned Tahsildar.

3. In the facts and circumstances of the case, this Court cannot grant the relief as sought for by the petitioner. However, there shall be a direction to the Tahsildar, Perundurai, to call the parties and take a decision with regard to the conducting of the festival on or before 21.11.2018. respondent Police shall act in accordance with the decision taken by the Tahsildar, Perundurai, in this regard. 4.In the result, this Criminal Original Petition is disposed of with the above directions.
