O R D E R

The Writ Petition has been filed seeking a direction to the respondent to receive the petitioner application No.979176718 dated 09.05.2018 seeking for Driving license. The petitioner is a physically challenged person and he has obtained the certificate of physical ability for Driving Motor Vehicles from the Government Institute of Rehabilitation Medicine, K.K. Nagar, Chennai - 600 083. The petitioner approached the respondent for Driving License along with necessary required documents. But the respondent refuse to receive the application, hence the present Writ Petition has been filed by the petitioner.

2. Earlier notice was ordered to the respondent. Today, when the matter was taken up for hearing, Mr.V.Prabhu, learned counsel appears for the respondent, on instruction, submitted that the petitioner did not submit his application along with required documents like address proof, proof of Date of Birth, Citizenship proof etc., as per Rule 4 of Central Motor Vehicles Rules along with recommendation of Medical Board for driving motor vehicles. If the petitioner filed his application as per Rule, the application will be received and will be considered as per the Motor Vehicles Act.

3. I have heard the rival submissions and perused the materials available on records.

4. Considering the above submissions, the petitioner is directed to file an application along with all the required documents before the respondent within a period of one week from the date of receipt of a copy of this order. After the receipt of the same, the respondent is directed to consider the petitioner's application and pass suitable orders within a period of two weeks.

5. With the above directions, this Writ Petition is disposed of. No costs.
