This petition has been filed to pass an order directing the V Additional Family Court, Chennai to dispose of M.C.No.348 of 2013 on merits expeditiously within a time frame to be fixed by this Court.
2.The 1st petitioner is the wife and the 2nd petitioner is the son of the respondent. Due to family dispute, the petitioners have filed a petition in M.C.No.348 of 2013 under Section 125 of Cr.P.C., seeking maintenance pending on the file of the Family Court, Chennai. This proceeding is pending before the Court below more than five years. Therefore, this Court does not want to entertain this Criminal Original Petition at this stage.
3.Taking into the consideration the facts and circumstances of the case, this Court directs the Court below to complete the proceedings in M.C.No.348 of 2013 within a period of three months from the date of receipt of a copy of this order.
