PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to set aside the order dated 04.10.2018 made in C.M.P. No.7069 of 2017 in S.T.C. No.593 of 2016 on the file of the Fast Track Court - II, (Magisterial Level), Erode by allowing this Criminal Original Petition.

O R D E R

This Criminal Original Petition has been filed aggrieved by the order passed by the Court below refusing to split up the case as against A3 and to continue with the case as against the A1, A2 and A4.

2. The learned counsel for the petitioner would submit that the complaint was filed in the year 2016 and A3 is intentionally https://hcservices.ecourts.gov.in/hcservices/

evading summons and did not appear before the Court. Since the case was pending without any progress, the petitioner filed a petition seeking for splitting up of the case. The same was dismissed by the Court below.

3. The Criminal Original Petition is disposed of with a direction to the Court below to follow the guidelines given by this Court in Criminal OP No.28952 of 2018, dated 19.12.2018 and proceed further in accordance with law.
