Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus seeking direction to the first respondent herein to pass appropriate orders on merit and in accordance with the Law by disposing of the Petitioners preferred against the order of the 2nd Respondent in proceedings No.Na.Ka.No.9603/E1/27 dated:15/12/2017 awarding punishment of stoppage of increment for 3 months without cumulative effect pending of the file of 1st Respondent herein within a period of time as prescribed by the Hon'ble Court. appeal dated 02.05.2018.

O R D E R

The petitioner, who was working as a lab assistant in the second respondent institution, suffered a punishment of stoppage of increment for a period of three months with cumulative effect. Challenging the punishment, the petitioner preferred an appeal dated 02.05.2018, which is pending before the first respondent. As the first respondent did not pass any orders, this writ petition has been filed.

2. Mr.A.N.Thambidurai, learned Special Government Pleader takes notice for the respondents.

3. Heard the learned counsel appearing on either side and perused the materials available on record.

4. In view of the limited relief sought for, this Court is of the view that it is not necessary to dwell into the merits of the issue, but it would be suffice to direct the respondents to consider the appeal preferred by the petitioner dated 02.05.2018 and pass orders on the same within a particular time frame.

5. In the above circumstances, this writ petition is disposed of directing the respondents to consider the appeal filed by the petitioner and pass orders thereon, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
