Respondents PRAYER : This Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to hear and dispose of the First Appeal filed on 19.02.2018 against the order of the 2nd respondent District Collector, Krishnagiri passed in Roc.

No.148/2012/Mines-2 dated 21.05.2012 on merits, within the time frame fixed by this Court.

O R D E R

This Writ Petition has been filed seeking to direct the first respondent to hear and dispose of the First Appeal filed on 19.02.2018 against the order of the 2nd respondent District Collector, Krishnagiri passed in Roc. No.148/2012/Mines-2 dated 21.05.2012 on merits, within the time frame fixed by this Court.

2. The learned counsel for the petitioner would submit that the petitioner has preferred an appeal before the 1st respondent https://hcservices.ecourts.gov.in/hcservices/

on 19.02.2018, challenging the order passed against the 2nd respondent and the same is pending. Since no order has been passed by the 1st respondent in the aforesaid appeal, this writ petition has been filed.

3. The learned Additional Government Pleader submitted that the aforesaid appeal, if it is in order, will be considered and suitable orders will be passed, in accordance with law.

4. Taking note of the said fact, without expressing any opinion on merits, this Court is inclined to direct the 1st respondent to dispose of the appeal dated 19.02.2018 filed by the petitioner, on merits and in accordance with law, as expeditiously as possible preferably within a period of eight weeks from the date of receipt of a copy of this order. No order as to costs.
