CR.NO.5 OF 2015 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the bail condition viz., the petitioner shall appear before learned XVI Metropolitan Magistrate Court, George Town, Chennai, on the 1st working day of every month at 10.30 a.m dated 21.08.2018. passed by this Hon'ble Court in Crl.M.P.No.10993 of 2018 in Crl.R.C.No.950 of 2018.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.P.K.MOHAN VEL, Advocate for the petitioner, and of MR. R.SURYA PRAKASH, Govt. Advocate [PUBLIC PROSECUTOR, MADRAS] on behalf of the Respondent, the court made the following order:- This miscellaneous petition has been seeking to modify the condition imposed on the petitioner by order dated 21.08.2018, granting bail.
The learned counsel for the petitioner would submit that the conditions imposed by this Court has been regularly complied with and the petitioner is facing difficulty to comply with the same due to pendency of other proceedings. Therefore, the petitioner seeks to modify the condition imposed by this Court by order dated 21.08.2017. This Court is not inclined to modify the condition, since the petitioner was directed to appear before the Court below only once in a month and this Court is ready to take up the main revision itself.
