PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to direct the respondent to proceed with the above Sessions Case No.7 of 2018 on the file of the III Additional Sessions Judge, Puducherry, as expeditiously as possible. O R D E R

This petition has been filed to direct the respondent to proceed with the above Sessions Case No.7 of 2018 on the file of the III Additional Sessions Judge, Puducherry, as expeditiously as possible.

2. The petitioner has been arrayed as A11 and he is facing trial before the III Additional Sessions Judge, Puducherry, in S.C.No.7 of 2018.

3. Earlier, the petitioner had filed Crl.O.P.No.6980 of 2018 before this Court, seeking for disposal of the case as expeditiously as possible. This Court, by an order dated 14.03.2018, directed the Court below to expedite the trial and complete the same as early as possible.

4. The learned counsel for the petitioner would submit that till today, not even the charges have been framed. The learned counsel would further submit that some of the accused persons are absconding and Non Bailable Warrant is pending and on that ground, the case before the Court below is pending for a long time.

5. In the facts and circumstances of the case, if the Court below finds that there is no chance of securing the absconding accused immediately, the Court below can split up the case and proceed further with the available accused person. The Court below is directed to complete the proceedings in S.C.No.7 of 2018, within a period of six months from the date of receipt of a copy of this order.

6. With the above direction, this Criminal Original Petition is petition is disposed of.
