.Respondent PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to direct the respondent police to grant an adequate police protection to the petitioner's Petrol Bunk namely A.C.M. Petroleum Agency, situated at Doddarthanahalli, Palacode Taluk, Dharmapuri District by initiating appropriate actions against the accused persons based on the complaint given by the petitioner dated 03.03.2018 on the file of the Inspector of Police, Palacode Police Station, Dharmapuri District.

O R D E R

This petition has been filed seeking for police protection.

2. It is seen from the records that the petitioner is running a petrol bunk and he has got a dealership from the Indian Oil Corporation Limited. The elder brother of the petitioner is causing disturbance to the petitioner from running the petrol bunk. In the year 2015, an attempt was made with the help of henchmen and based on the complaint given by the petitioner, the police held an enquiry and advised the elder brother of the petitioner not to interfere with the running of the petrol bunk.

3. The learned counsel for the petitioner would submit that the elder brother of the petitioner has again started interfering with the running of the business with the help of henchmen.

4. In the facts and circumstances of the case, there shall be a direction to the respondent to call the parties and https://hcservices.ecourts.gov.in/hcservices/

conduct an enquiry and take further action in accordance with law. It is made clear that if the respondent finds that the issue is civil in nature, the respondent police shall relegate the parties to the appropriate civil Court.

5. With the above direction, this Criminal Original Petition is disposed of.
