Prayer: Criminal Original Petition filed under Section 482 of Cr.P.C, to direct the first respondent to transfer the investigation from the third respondent concerned to second respondent in Crime No.409 of 2018 to that of any other investigating agency.

ORDER

This petition has been filed seeking for transfer of investigation from the third respondent, which is pending in Crime No.409 of 2018.

2. The third respondent has registered an FIR for an offence under Sections 294 (b) and 324 of IPC. According to the petitioner, the respondent police have not arrested the accused persons and there is no progress in the investigation. Therefore, the present petition has been filed before this Court. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Additional Public Prosecutor on instructions would submit that there are three accused persons in this case and all the three accused persons were arrested by the second respondent police. That apart, in the course of investigation, FIR has also been altered by adding offence under Section 506 (ii) apart from the under Sections 294 (b) and 324 of IPC. The learned Additional Public Prosecutor would further submit that the investigation has almost been completed by the respondent police.

4. In view of the above, this Court is not inclined to interfere with the investigation at this stage.

5. This Criminal Original Petition is disposed of with a direction to the third respondent to complete the investigation and to file a final report within a period of one month from the date of receipt of copy of this order.
