This Court by order, dated 03.12.2018 appointed the Advocate Commissioner, who on receipt of the warrant proceeded to execute the same, thereby he found the vehicle in question and seized the same and in fact handed over the same to the applicant company and the receipt of the vehicle is also acknowledged by the learned counsel appearing for the applicant.

2. The learned counsel appearing for the applicant would further submit that, after the vehicle was seized, the respondent / borrower had come forward for settlement and he has paid the overdue as of now and thereafter regularised the account, therefore the account has been regularised and the vehicle which was seized by the Advocate Commissioner had been returned back to the respondent / borrower.

3. Since the learned Advocate Commissioner has completed the task, she has filed a report to that effect before this Court. Along with the report, she has also filed a memo seeking for additional remuneration and also seeks a sum of Rs.5,000/-, which she incurred for travelling, boarding and lodging. http://www.judis.nic.in

Considering the efforts taken by the Advocate Commissioner, this Court is inclined to allow a sum of Rs.20,000/- towards additional remuneration and Rs.5,000/- towards the expenses she incurred, altogether a total sum of Rs.25,000/- (Rupees Twenty Five Thousand only), shall be paid the applicant company to the Advocate Commissioner, within a period of one week from the date of receipt of a copy of this order.

5. Since the warrant has been executed and the vehicle has been handed over to the applicant and thereafter the loan account also has been regularised and the vehicle has also been returned back to the respondent, no further order is required to be passed in this application.
