PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to call for the records and quashing the F.I.R and all further proceedings against the petitioner in Crime No.08 of 2018 pending investigation on the file of the 1st respondent herein.

O R D E R

This petition has been filed seeking to quash the F.I.R in Crime No.08 of 2018, pending on the file of the respondent Police.

2.As per the complaint given by the 2nd respondent, there was a love affair between the petitioner and the 2nd respondent and subsequently, the petitioner refused to marry the 2nd respondent. Based on the complaint, the respondent Police has registered an F.I.R for an offence under Sections 417, 420 and 506(i) of I.P.C.

3.During the course of investigation, the parties have decided to settle their dispute among themselves. Today, the defacto-complainant and the petitioner were present before this Court. The defacto-complainant has filed an affidavit before this Court stating that matter has been compromised between the parties, on the advice of the elders and both the petitioner and the defacto-complainant have decided to part their ways and live a happy life independently without any further claims against each other. When this Court questioned the defacto-complainant, the defacto-complainant reiterated the very same stand. The parties have also filed a Memo of Compromise before this Court and have sought for quashing of the F.I.R on the ground of compromise.

4.In view of the above development, no useful purpose will be served by keeping the F.I.R pending. Accordingly, the F.I.R in Crime No.08 of 2018 on the file of the 1st respondent Police is hereby quashed. Hence, this Criminal Original Petition is Allowed in terms of the Affidavit of the 2nd respondent and also the Memo of Compromise filed by the petitioner and the 2nd respondent before this Court.
