Prayer: Criminal Original Petition filed under Section 482 of Cr.P.C, to issue directions, directing the second respondent to depute the seventh respondent and conduct the investigation on the basis of the complaint lodged by the petitioner on 19.07.2018 before the third respondent. Consequently, directing the 7th respondent to recover the stolen properties of the 65,571 bags of groundnut kernels (each 47Kg) from the Periyasamy and his gang.

ORDER

This petition has been filed seeking for a direction to the second respondent to depute the seventh respondent and conduct the investigation based on the complaint lodged by the petitioner on 19.07.2018 before the third respondent.

2. It is seen from the records that a complaint has been given by the petitioner before the respondent police on 18.07.2018 and a receipt has also been given for the same. However, till date no action has been taken on the complaint. Earlier the same petitioner approached this Court seeking for a direction to the respondent police to register the case based on the petitioner's complaint dated 19.07.2018 and this Court by an order dated 26.09.2018 directed the petitioner to follow the guide lines given by the Hon'ble Division Bench in G.Prabakaran Vs The Superintendent of Police, Thanjavur District and another in (Crl.O.P.(MD).No. 13681 of 2018 etc., batch).

3. Even after the above said order, the petitioner, without following the guide lines of the Hon'ble Division Bench has again approached this Court seeking for the above said direction. The petitioner has to work out his remedy in accordance with the directions given by this Court in Crl.O.P.No.22945 of 2018 dated 26.09.2018 and get an FIR registered against the accused persons. If inspite of the registration of the FIR, no action is taken, it is always open to the aggrieved person to approach this Court seeking for appropriate relief. At this stage, this Court is not in position to grant the relief as sought for by the petitioner.

4. In a result, the Criminal Original Petition is disposed of with the above direction.

5. As and when a petition by the petitioner is filed under Section 156 (3) Cr.P.C before the concerned Magistrate.
