(Order of the Court was made by R.SURESH KUMAR, J.) Heard the learned counsel appearing for both sides.

2. The delay is 836 days which is more than two years, therefore, by virtue of this long delay, definitely some prejudice would have been caused to the respondent, therefore, in order to compensate the same, we are inclined to allow this petition only on terms, therefore, this petition is ordered on payment of cost of Rs.5,000/- (Rupees Five Thousand only) payable by the petitioners to the respondent through the learned counsel for the respondent, within a period of two weeks from the date of receipt 2/4

of a copy of this order. On such condition, this Civil Miscellaneous Petition is ordered.
