This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for the records in Na.Ka.aa2/12674/ 2016 dated 05.09.2018 on the file of the Revenue Divisional Officer, Perambalur District relating to the impugned order dated 05.09.2018 and quash the same as illegal, arbitrary and devoid of merit and consequently direct the third respondent to issue patta in the petitioner's name in respect of the lands in Survey No.342/5b to an extent of 6 1/2 cents in Somandapudur Village, Kizhakarai Revenue Village, Perambalur Taluk, Perambalur District. 2.Though the petitioner has sought for a larger relief, the learned counsel appearing for the petitioner submitted that this Court, without going into the merits of the case, may grant liberty to the 2/4

petitioner to approach the competent civil Court as against the private respondents and grant further liberty to the petitioner to make fresh application for transfer of patta if the petitioner succeeds in the suit that is to be filed by the petitioner.

3.The learned Government Advocate appearing for the respondents 1 to 3 and the learned counsel appearing for the fifth respondent raise no serious objection.

4.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case and without interfering with the impugned order, grants liberty to the petitioner to approach the competent civil Court for appropriate remedy. The period during which the writ petition was pending before this Court is excluded for the purpose of limitation. 5.The writ petition is disposed of in the above terms. No costs.
