CMP.No.22586 of 2018 in Tr.CMP.No.625 of 2018 TRJ Learned Counsel for the petitioner stated that the earlier Counsel, who was presenting the matter met with an accident as a result, he was unable to attend the Court on 9.10.2018, resultantly the Tr.CMP.No.625 of 2018 was dismissed for non prosecution. Although the information was belatedly communicated, there was a delay of 22 days in filing the restoration petition, which is neither wilful nor wanton. Hence, the delay may be condoned and the matter can be restored to file.
Since there is no serious objection from the other side, the delay is condoned. Post the restoration petition for hearing on 21.6.2019.
