O R D E R

This Transfer Civil Miscellaneous Petition has been filed seeking transfer of H.M.O.P.No.247 of 2016 pending on the file of Family Court, Trichy to the file of the Family Court, Salem.

2. The respondent and the petitioner are husband and wife. The respondent/husband has filed a petition in H.M.O.P.No.247 of 2016 for divorce before the Family Court, Trichy. The petitioner/wife has filed a petition in F.C.O.P.No.465 of 2018 for restitution of conjugal rights before the Family Court, Salem.

3. The petitioner/wife is presently working as a Sub-Divisional Engineer (Cables) in the Office of the General Manager, BSNL, Salem. The respondent/husband was employed as Assistant Chief Post Master at Chennai and retired from the service. On account of employment as well as physical hardship, the petitioner/wife finds it difficult to appear before the Family Court, Trichy which is at a distance of 150 km from Salem.

4. Considering the convenience of both the parties, this Court is inclined to transfer the petition filed by the husband before the Family Court, Trichy to Family Court, Salem.

5. Accordingly, H.M.O.P.No.247 of 2016 pending on the file of Family Court, Trichy is withdrawn and transferred to the file of Family Court, Salem to be tried along with F.C.O.P.No.465 of 2018.

6. The Transfer Civil Miscellaneous Petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
