O R D E R

This petition has been filed for a direction to the third respondent police not to harass the petitioner.

2. It is seen from the records that already there was a civil litigation between the parties and a decree has also been passed in favour of the petitioner. In spite of the same, the other side is continuing to threaten the petitioner and also lodging several complaints before the respondent police. Based on the complaint given by the other side, the third respondent police is calling the petitioner for enquiry. https://hcservices.ecourts.gov.in/hcservices/

3. Since, there is already civil Court decree in favour of the petitioner, the persons who are bound by the decree should workout their remedy only by filing an appeal and they cannot parallely give complaints to the police. The third respondent shall relegate the parties to workout their remedy before the Civil Court. The third respondent shall not call the petitioner for enquiry and harass him.

4. This Criminal Original Petition is disposed of with the above directions.
