Respondents For Petitioner :M/s.Bhoopathy Raja For Respondent :Mr.K.Rajendra Prasad Additional Government Pleader
Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the 6th respondent to consider the petitioner's representation dated 28.05.2018 within a stipulated period that may be fixed by this Honourable Court and fix the revised grade pay as Rs.4,400/- as per G.O.Ms.No.325 dated 22.07.2013 and G.O.No.338 dated 26.08.2010.
O R D E R
This writ petition has been filed seeking direction to the sixth respondent to consider the representation dated 28.05.2018, wherein the petitioner has claimed revised grade pay of Rs.4400/- as per the G.O.Ms.No.325 dated 22.07.2013 and G.O.No.338 dated 26.08.2010.
2. It is the claim of the petitioner that his claim has been accepted and the seventh respondent / Executive Engineer has already sent a letter dated 23.02.2015 to the sixth respondent, stating that the petitioner is entitled to revised grade pay of Rs.4400/- with effect from 01.04.2013. Learned counsel for the petitioner contends that despite the order being passed in favour of the petitioner, the sixth respondent has not implemented the same and that has made the petitioner to file the present writ petition.
3. It is not in dispute that already the seventh respondent has passed an order dated 23.02.2015 and the same ought to have been implemented by the sixth respondent. Under the circumstances, without going into the merits of the matter, this Court deems it fit to direct the sixth respondent to consider the petitioner's representation dated 28.05.2018 in the light of the letter of the seventh respondent dated 23.02.2015, and pass orders thereon, in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. No costs.
